Warranty Policy

This Warranty Policy applies to all products sold on athovita.com by DL Performance Marketing LLC, operator of the Athovita™ brand (“Athovita,” “we,” “us,” or “our”). It works alongside our Return & Refund Policy and our 60-day money-back guarantee.

Athovita Quality Promise

Athovita formulations are manufactured in GMP-certified facilities in the United States, third-party tested for purity and potency, and produced under documented batch-level quality controls. We design every product to meet or exceed the labeled potency through the printed best-by date when stored as directed (sealed, in a cool, dry place out of direct sunlight).

Limited Product Warranty

We warrant that, at the time of delivery, each Athovita product is:

  • Free from material defects in manufacturing and workmanship;
  • Properly sealed and packaged in undamaged primary packaging; and
  • Manufactured to match the active ingredient potency printed on the label, subject to standard manufacturing tolerances and stated stability through the printed best-by date.

Coverage Period

This warranty covers each product for 60 days from the date of delivery, aligned with our 60-day money-back guarantee. The 60-day window starts on the carrier-confirmed delivery date for that specific order. Subscription shipments are independently covered — each shipment carries its own 60-day warranty starting on its delivery date.

Remedy: Replacement or Refund

If a warranty claim is approved, you may elect one of the following remedies, at your choice:

  • A free replacement of the affected product, shipped at no cost to you; or
  • A full refund of the affected product’s purchase price to your original payment method, processed within 3–7 business days.

You do not need to return the affected product to receive a warranty remedy — we ask only that you provide photos sufficient to document the defect. There are no restocking or processing fees.

How to File a Warranty Claim

  1. Email help@athovita.com within 60 days of delivery, with “Warranty Claim” in the subject line.
  2. Include your order number, the batch / lot number printed on the bottle, and clear photos showing the issue (e.g. broken seal, damaged bottle, visible contamination).
  3. Indicate your preferred remedy: replacement or refund.
  4. We will confirm receipt within 1 business day and, in most cases, dispatch the replacement or process the refund on the same business day the claim is approved.

Exclusions

This warranty does not cover, and we are not responsible for:

  • Normal product consumption (an empty or partially empty bottle that has been used as intended);
  • Damage caused by misuse, mishandling, exposure to extreme temperatures or moisture, or storage outside the conditions printed on the label, occurring after delivery;
  • Products that have been altered, repackaged, decanted, or tampered with after delivery;
  • Products purchased from any source other than athovita.com (including unauthorized third-party resellers on marketplaces or other websites — only purchases directly from athovita.com are eligible);
  • Cosmetic variations such as minor differences in tablet/capsule color, smell, or appearance that do not affect potency or safety; and
  • Personal preference, taste, or individual response to the supplement — these are covered by our broader 60-day money-back guarantee in the Return & Refund Policy, not by this Warranty Policy.

Athovita products are dietary supplements. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease. No Other Warranties; Limitation of Liability

To the maximum extent permitted by law, the limited warranty above is the sole and exclusive warranty applicable to Athovita products. We disclaim all other express or implied warranties, including any implied warranty of merchantability or fitness for a particular purpose, except where such disclaimers are prohibited by applicable law.

Our maximum aggregate liability under this warranty for any single product is limited to the purchase price you paid for that product. We are not liable for indirect, incidental, special, consequential, or punitive damages, except where applicable law does not permit such limitations.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of incidental or consequential damages. In those jurisdictions, the limitations above apply only to the extent permitted by law, and you may have additional rights under the laws of your state.

Governing Law

This Warranty Policy is governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles. Any dispute arising out of or relating to this warranty shall be resolved exclusively in the state or federal courts located in that State, or through binding arbitration if mutually agreed in writing.
